A resolution to make combat rising corruption within the Civil Service.

Passed ddmmmyyyy with # Aye, # Nay, # Abstain.

Be it resolved

IDENTIFYING the present lack of government accountability;

RECOGNISING the exponentional loss of public funds via corruption;

PREPARING for the complexities of a financially and technologically complex future;

HEREBY alters Title 1 of the Kodiak Law Code to:

  • Amend The Kodiak Felony Act (637)
  • Amend The National Kodiak Police Act (Inter)
  • Enact The Centralized Justice Act, 645
  • Enact The Monitoring Act, 645

Amendment of The Kodiak Felony Act (637)

To refine judical process through the creation of a State Crimes category. Enacted ## MONTH 2022.

Amends the aforementioned act, combining Articles 6,7,8 into a central State Crimes. Article 7 Repurposed for Untracable Wealth. Article 10 adjusted due to previous articles being renumbered.

Article 6 - State Crimes

6.1 - Treason and Conspiracy to Commit Treason
6.1.1 - Any Act planned to weaken or start war against the Republic or aiding the enimies of the State.
6.1.2 - Punishable by a maximum of 30 years in Federal Prison.
6.2 - Espionage
6.2.1 - Any Act in service to another state or non state organization with intent to obtain information for malicious purposes.
6.2.2 - Punishable by a maximum of 20 years in Federal Prison.
6.3 - Sedition
6.3.1 - Any Act in which two or more people conspire to overthrow the government or oppose the legal authority of the nation by force
6.3.2 - Incitement to Insurrection shall be a subcharge defined as provocation of unlawful behaviour,
6.3.3 - Insurrection is defined as a violent uprising against an authority or government.
6.3.4 - Punishable by a maximum of 20 years in Federal Prison
6.4 - Corruption
6.4.1 - Dishonest or fraudulent conduct by those in service to the government of the Kodiak Republic.
6.4.2 - Subcategories of Corruption shall include charges of bribery, lobbying, extortion, cronyism, nepotism, parochialism, patronage, influence peddling, graft, and embezzlement.
6.4.3 - Punishable by a maximum of 20 years in Federal Prison


Article 7 - Untraceable Wealth

7.1 - An Act to delibertly hide sources of income 7.2 - Punishable by fines with a maximum of 250% the hidden value of wealth.


Article 8 - Disclaimer

This is not an explicit list of crimes in Kodiak. It should not be assumed that all crimes not in the Felony Code are legal and these offenses can also result in dire consequences by judicial trial. This is just a tool to give the Police flexibility to make decisions on the spot when the facts of a case are clear.

The Centralized Justice Act, 645

An act to codify the court systems of the Republic not specificied within the Constitution of the Kodiak Republic. Enforces the Legal Code of the Kodiak Republic under a system of Common Law.

Enacted ## MONTH 2022.

Article 1 - Federal Court System

1.1 - Establishes the Federal Court of Appeals.
1.1.1 - The Federal Court of Appeals shall consist of eleven (11) appellate courts to hear appeals throughout the Republic.
1.1.2 - Empowers the Federal Court of Appeals to adjudicate cases steming from appeals of Provincial Trial Courts or Federal District Courts
1.1.3 - Each appellate court shall consist of three (3) judges without a jury.
1.2 - Establishes the Federal District Court
1.2.1 - Each Province shall have at least one (1) Federal District Court to hear cases. Additional Courts shall be established by the Ministry of Justice
1.2.2 - Empowers the Federal District Court to try cases involving disputes of the Public Law Code.
1.2.3 - Empowers this court with the exlusive right to try Bankruptcy cases.
1.2.4 - Shall consist of a federal judge to try the case and Jury to decide the case.
1.3 - Establishes the Federal Tax Court.
1.3.1 - Empowered with exclusive right to try cases involving Kodiak Tax Code disputes.
1.3.2 - Shall consist of one (1) judge and no jury.
1.4 - Establishes the Special Court for State Crimes
1.4.1 - Shall consist of three (3) judges and no jury.
1.4.2 - Empowers this court to exclusively try crimes against the government of The Kodiak Republic.
1.4.3 - Proceedings are closed to the public.
1.5 - Establishes the Courts of Military Tribuneral
1.5.1 - Empowers the Ministry of Defense to regulate guidelines and policies related to the Uniform Code of Military Justice.
1.5.2 - Establishes juristiction to all cases that fall within UCMJ or within areas that are directly administered by Military Officials.
1.5.3 - Proceedings are closed to the public.

Article 2 - Provincial Court System

2.1 - Establishes the Provincial Trail Courts
2.1.1 - Shall consist of a judge to try the case and jury to decide the case.
2.1.2 - Empowers the court to try civil and criminal cases involving violations of law codes within provincial borders.
2.2 - Provinces may further refine Provincial Law systems subordinate to the Miniatry of Justice and subject to review by the High Court of the Republic
