Is there a presumption in the language that the separation would exist only while under civilian control, or is there an intent never to permit the use of military law inside the borders of the republic? Bernard Glocke [I] — 19/03/2024 13:08 Under the Executive Powers Resolution, 645, I feel that the language for Martial Law was already established as precident. The mainstay of the argument being that the Military should not have presence in Law Enforcement outside of Martial Law or through the Resolution of the Assembly outlined in 6.1.1 of this Act However, I do upon rereading find that it does lack in that language in terms of what that would mean. Are we trying to separate military authority from Civil Law Enforcement? Bernard Glocke [I] — 26/03/2024 08:49 This is a codification that the Military is not a Law Enforcement or Domestic Police service. As it stands right now we have the precedent of Martial Law whereby the Chancellor may authorize the military to enforce law and order in declared zones. However what is missing is a provision that prevents the Military from acting as that force in any other scenario without authorization.

As it stands now, if a local commander wanted to roll forces out to deal with a disturbance he would not violate any particular laws. This would lead to precedent where the Military effectively could assume de facto Martial Law at will. It also creates a scenario where the Military is conducting an Operation in Crystal City, obtains information about a possible Commune terror plot in the Darrent, acts against that threat without the police, and drops a bomb on a school.

This bill does allow any information collected by the military to be shared with Police if it has information on Kodiaker Citizens to enable the NKP or SBI or CTS to deal with such measures.
