WITH 16 AYE, 4 NAY, 2 ABSTAINS

Preamble

Recognizing the importance of maintaining law and order under the auspices of democratically controlled institutions and acknowledging that unregulated armed groups pose a threat to public safety, civil liberties, and the rule of law, the Kodiak Republic resolves to prohibit the formation and operation of vigilante militias within its jurisdiction.

Article 1 - Short Title and Enactment into Law Code

1.1 - This Resolution may be cited as the "Vigilante Militia Ban."
1.2 - This Article hereby creates section 7 named "Vigilante Militia Ban" under Title 1, Chapter 8 in the Kodiak Law Code.
1.3 - Section 7 enacts:

Section 7 - Vigilante Militia Ban

Establishment

1.1 - "Vigilante Militia" refers to any non-state group or organization, composed of individuals who arm themselves and claim to enforce laws, deliver justice, or provide security services independently of the officially sanctioned law enforcement agencies of the Kodiak Republic.
1.2 - "Law Enforcement Agencies" refers to the state-sanctioned bodies, including but not limited to police, military, and security forces, empowered by the government of the Kodiak Republic to enforce laws and maintain public order.
1.3 "Armed Group" includes any organization or assembly of individuals possessing or utilizing weapons, including but not limited to firearms, explosives, or any other tools capable of inflicting serious harm, with the intent of engaging in activities resembling law enforcement or justice delivery.

Prohibition

1.4 - The formation, operation, or promotion of vigilante militias within the Kodiak Republic is hereby prohibited.
1.5 It shall be unlawful for any individual or group to:
1.5.1 - Organize, recruit, or train individuals with the intent of forming a vigilante militia.
1.5.2 - Participate in, support, or finance the activities of a vigilante militia.
1.5.3 - Publicly advocate for the establishment or operation of vigilante militias.

Enforcement

1.6 - Any individual or group found in violation of this resolution shall be subject to penalties, including but not limited to:
1.6.1 - Fines, imprisonment, or both, as determined by the judiciary of the Kodiak Republic.
1.6.2 - Confiscation of weapons and dissolution of the offending group.
1.7 Law enforcement agencies are authorized to:
1.7.1 - Monitor and investigate activities suspected of violating this resolution.
1.7.2 - Take necessary actions to prevent the formation or operation of vigilante militias.

Exceptions

1.8 - This resolution does not apply to:
1.8.1 - State-sanctioned law enforcement agencies and their authorized personnel.

Implementation and Review

1.9 - This resolution shall take effect immediately upon its adoption.
1.10 - The Ministry of Justice shall oversee the implementation and enforcement of this resolution and provide an annual report to the legislature on its effectiveness.
1.11 - This resolution shall be subject to review every five years to assess its impact and make any necessary amendments.
